My 19 year old son was found hanging in a public park in McGregor, Tx on Feb. 16, 2006.
McGregor, Populatioin: 5,100/8 police officers
I and my two sons had been living there for 8 years at this time, and all the officers knew my sons, especially Joshua.
Yet, when they arrived on scene, they stated they did not recognize Josh. Only 8 minutes later, Officer Norris ran a wants/warrants check on him with no identification, nor a suicide note. Obviously, he knew the Name and Date of Birth!
When the Justice of the Peace pronounced him deceased @ 6:15AM, it is noted in the statements that the JP, EMS, and the officers asked each other if they knew who this person was, and they all agreed they did not know.
When he was removed from the chain, as he was on his knees, they pulled the back of his shirt down, revealing ROBINSON tattooed across his upper back and commented, "because of the proximity to the Robinson's home, they figured he must be a cousin they had never dealt with."
I contacted Interim Chief Molina about the progress of the investigation, and he told me there is no investigation until something suspicious is found. I told him the whole thing is suspicious. I asked him why no officer had shown up to escort the funeral procession and he told me, "we were unavailable", which is not true, as the detective's car was parked behind the police station, there were two @ Subway, and our procession almost collided with another patrol car enroute. Molina told me, "we do funersals for everybody in McGregor", and I said, "Just not for Josh Robinson, right?"
It is no secret that there was animosity between the police and my son, as they knew him on sight, on a first name basis, and had even arrested him more than once as a juvenile.
Twelve days later, the detective contacts me to let me know the investigation is over as of today. I ask, "What investigation, Molina told me there wasn't one?" He tells me the investigation he did. He told me he had talked to my surviving son, Michael, Josh's girlfriend Kayla, and Mr. Holt, who runs the perimeter of the park every day. I knew he hadn't, but to be certain, I told him I would call him right back.
As Michael and Kayla were at our home, I asked. Michael said that the det. talked to him while at the park, but couldn't recall the conversation. Kayla said no one had talked to her. I called Mr. Holt, and he said the same thing.
I called the det. back and told him he hadn't talked to anyone but Michael. He told me he found out all he needed to know from him. I asked to see his written notes, and he told me he hadn't written anything down.
Mr. Holt's son, Justin, called our home about 6:30AM telling Michael what his dad had told him: that someone was hanging in the park.
In my heart, I knew immediately that it was Josh, but hope against hope, I asked Michael to run down there (one block away), see what's going on, and come right back. He didn't.
I began my own investigation.
Cause of Death: Red-purple parenchyma with pulmonary edema.
Manner of Death: Death By Hanging
McGregor rec'd a new chief on May 1, 2006.
June, 2006, four of the five officers on scene are asked to resign inexplicably.
I attempt to speak with the new chief, as I want pertinent questions answered:
1) How and why were you able to run a wants/warrants check on someone you state you don't recognize?
Answer: Although it took 2 months to get this answer, and then only through the mayor, I was told the check is done in case there is a warrant, it can be dismissed. [Who cares, he's dead!!]
2) How was it possible that Officer Kirby was the first on scene, checking for a pulse, as his patrol car was NOT dispatched to the park?
Answer: "I'm not talking about it."
3) Why was Sgt. Freeman called in @ 4:37AM?
Answer: "I'm not talking about it."
The chief then told me I needed to leave his office.
I then learned that an officer was the last person to see Josh alive in the park @ 1AM, so I once again contacted the chief to ask which officer. He said, "I can't remember."
I learned that parenchyma is the outside lining of the lungs, and it had been traumatized, bleeding into the cavity, causing his death. There are four major factors of Parenchyma:
Left Ventricle Failure
Congestive Heart Failure
Near Drowning
Chest Trauma
I contacted the Medical Examiner. He told me he had initially ruled the death as Undetermined, but because of a report sent by Det. Martin, he changed the ruling to suicide. I asked to see this report, but he told me I couldn't. I have since sent a Freedom of Information form to Dallas to get this report. He also told me there was no evidence of strangulation, which I thought extremely odd, as the Manner was death by hanging.
I know from the autopsy that there was no damage to the neck. His neck had not been broken. There was only bruising from the chain marks, bruising on his left fingertips which indicates an attempt to remove the ligature.
The chief "suggested" that I relocate, and I took his subtle threat seriously.
I firmly believe that this is a case of excessive force by police, and it was covered by placing him in the chain of the swing.
One agency tells me that I must get the Medical Examiner's ruling changed. Another says that I have to to go to the McGregor city council to request that the case be reopened.
I did go to the Justice of the Peace to request a formal inquest under the Texas Code Of Criminal Procedures, Article 49.04, but he "not so kindly" told me to take my problem to the District Attorney. The DA turned me back to the JP.
At this point, I am totally frustrated because no agency will look into the circumstances surrounding my son's death.
