We are supposed to have trial for Ms. Mackey on the 19th. She has decided to go without a jury. She got a change of venue in Sept. because she didn't think she would get a fair jury trial and now does not even want a jury. They are now talking plea bargains again, so I have no idea if we are even going to trial. Meanwhile, I have already gotten those days off from work and it may or may not be for any reason. I hate this crap. Will let you all know if we ever get anything going here. Val

In my opinion, the system allows the defendent to use everyone like yo-yo's. I think there needs to be a no waffling rule. This isn't defending the rights of the accused, it's allowing them to manipulate a system and waste resources. Although, I have heard statistically the chances of a judge socking it to the defendent is greater than chances of a jury doing it. So in a way, the defendent may have just hurt herself with this. i will be praying for justice on this. I know of a case where a man chose to decline a trial by jury and was convicted of assault before a judge and given a 3 year suspended sentence with the conviction showing on his criminal record. Even though he chose a bench trial, he was automatically granted an appeal because of his right to a jury trial. In essence the first trial was only an opportunity for him to see what kind of a case the prosecution had against him and to waste everyone's time and money. Then a week before the jury trial, the prosecutor plea bargained with him. After having already been convicted, he was given 6 months probation before judgement, which means in 6 months if he doens't beat anyone up, his record becomes clean. This man strangled a woman until she went unconscious and left her for dead. He returned and angry she was still alive and attacked her again. Luckily, I was there this time so his attack didn't go very far. This is not the first assault that has been wiped off this guy's record. Val, I know what you mean. We just continue to be raped by the system. My sister's killer agreed to a plea and backed out the day before sentencing. It was such a let down. Now I hope we get a death sentence. I'm thinking of you and keeping you in my prayers. Becky
