As you all know I have been going through the ordeal of a Motion to Dismiss for the last 21 months...
The judge heard arguments on Nov 4th and he set the date of Nov 22nd to give his decision. I didn't have to be in the courtroom since he was going to give his decision in writing. On that day I waited on pins and needles ALL DAY. Nothing... I called the DA's office That afternoon and the following morning. My advocate finally called back later that morning and said the judge has not made a decision.
He has set the case for status for Dec 15th. What the heck does that mean?
Also, I learned that the judge is now sitting on another session... The DA told the judges clerk not to let this fall into the legal system cracks. He assured him that he will keep reminding the judge.
I don't know what to think. Just very frustrating....
Any words of wisdom you can all share?

UPDATE
The DA's office just called and the motion has been DENIED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
I do not have all the details. I would like to get ahold of what the judge wrote in his decision! Good day for the good guys. Really bad day for the bad guys!
Hopefully now trial date (s) will be scheduled!

Wonderful news! I hope you will have those trials behind you as soon as possible , bless you all. In Texas, we had the right to get copies of all decision documents, so Just ask the DA for a copy. They should be able to provide you with a copy of the judge's decision/opinion. Yes, good day for the good guys (((HUGS))) to you, lmb

Yes, I should be able to get a copy of the decision. I wasn't able to ask too much this morning since my mom was nearby and she has no idea any of this is happening.
I'll call our advocate next week to get that document.
Ahh, finally some relief. Now the battle of the trials will begin...

I am happy you had some good news from a bad situation. I pray the trial results are the same, good news for good people and bad news for bad people.

I am glad someone has some good news in all the bad. I hope the trials go well for you and you get good results for the good people and bad for the bad. The 1st of 2 trials was scheduled for November 15th, but was rescheduled for the end of January in my husband's case. I found out through the grapevine that this particular suspect fired her court appointed attorney and has a new one, so now he needs time to prepare. She probably fired him because he kept trying to persuade her to take the Plea Deal she was offered but refused. She is stupid for not taking the Plea Deal. She will wind up going to prison for life without parole all for her man who got her into all this mess. I would never do what she did for any man. It would be in her best interest to take the Plea Deal and nail the man who got her into this mess. He is certainly doing absolutely nothing to help her out of this mess that he got her into. We will have a new DA in January before the 1st trial. I will certainly give the new DA an earful and make sure that things are handled differently not just for my husband's case, but for all cases. The DA should be for the Victims and not for criminals. Victims should be treated with fairness, compassion and respect. I think the new DA will be more hands on, aggressive in prosecution and for the victims. I wish you enough Justice to bring you some peace after the violence, pain and loss. I wish that for all victims.
